Poker Hawk – Terms of Use

Welcome to Poker Hawk, a platform by TourneyTek, Inc. for managing, hosting, and participating in live poker tournaments. These Terms of Use ("Terms") govern your access to and use of the Poker Hawk apps (desktop, web, and mobile), websites, and services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy.

1. Eligibility

You must be at least 18 years old (or the age of legal majority in your jurisdiction) to use the Service. By using Poker Hawk, you represent that you meet these requirements and have the legal capacity to enter into this agreement.

2. Accounts & Access

You are required to create an account using email or Google authentication, provided via Firebase Auth.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
If you suspect unauthorized use of your account, notify us immediately at support@pokerhawk.io.

3. Subscriptions & Payments

Access to premium features may require a paid subscription, managed via Stripe. All payments are final unless otherwise stated. Failure to pay may result in the suspension or termination of your access.

4. Use of the Service

You agree to use Poker Hawk only for lawful purposes and in accordance with these Terms. You may not:

Use the Service to run or promote illegal gambling;
Upload malicious code or interfere with the Service’s operations;
Access or attempt to access other users' data without permission;
Resell or redistribute Poker Hawk without express authorization.

5. Data & Privacy

We use Firebase Firestore and Realtime Database to store and sync data related to tournaments, users, clubs, and real-time gameplay events. By using the Service, you grant Poker Hawk permission to process this data to operate the platform effectively.

6. Intellectual Property

All content, trademarks, logos, and software associated with Poker Hawk are the property of TourneyTek, Inc. or its licensors. You may not use our branding or reverse engineer any part of the Service without written permission.

7. Availability & Modifications

We strive to ensure high availability, but we do not guarantee uninterrupted or error-free operation. Features may change, be removed, or added at our discretion. Continued use of the Service after changes indicates acceptance of the revised Terms.

8. Termination

We reserve the right to suspend or terminate your account at any time, without notice, if you violate these Terms or abuse the Service.

9. Disclaimer of Warranties

The Service is provided “as is” without warranties of any kind. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the maximum extent permitted by law, TourneyTek, Inc. is not liable for any indirect, incidental, or consequential damages resulting from your use of the Service.
