Poker Hawk – Terms of Use

These Terms of Use ("Terms") govern access to and use of Poker Hawk, including our websites, desktop software, mobile applications, TV display tools, and related services (collectively, the "Service"), provided by TourneyTek, Inc.("TourneyTek", "we", "our", or "us").
By creating an account, downloading, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the Service. By using Poker Hawk, you represent that you satisfy this requirement and can enter into a binding agreement.
2. Accounts & Access
- You must provide accurate account information and keep it current.
- You are responsible for maintaining the confidentiality of your credentials and all activity under your account.
- If you suspect unauthorized access, notify us immediately at support@pokerhawk.io.
3. Subscriptions & Payments
Certain features require paid subscriptions. Depending on platform, billing is processed by Apple App Store, Google Play, or Stripe (web). Subscriptions automatically renew unless canceled before the renewal date. Cancellation, renewal timing, and refund eligibility are governed by the payment provider's terms and policies.
Store-managed subscriptions (Apple/Google) must be managed through the applicable store account. Web subscriptions are managed through your Poker Hawk account and Stripe billing portal.
4. Use of the Service
You agree to use Poker Hawk lawfully and in accordance with these Terms. You may not:
- Use the Service to run or promote activity that is illegal in your jurisdiction;
- Upload malware, exploit vulnerabilities, or interfere with service operations;
- Access or attempt to access data that you are not authorized to access;
- Resell or redistribute Poker Hawk without express authorization.
5. Data & Privacy
We process account, tournament, and operational data to provide and improve the Service. Details on data handling, retention, and rights are described in our Privacy Policy.
6. Intellectual Property
Poker Hawk software, branding, content, and underlying technology are owned by TourneyTek or its licensors and protected by applicable law. Except for limited rights granted in these Terms, no license is granted to you.
7. Availability & Modifications
We may update, modify, suspend, or discontinue features at any time. We do not guarantee uninterrupted availability. Continued use after updates constitutes acceptance of revised Terms.
8. Termination
We may suspend or terminate access if you violate these Terms, misuse the Service, or create security/legal risk. You may stop using the Service at any time.
9. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
10. Limitation of Liability
To the maximum extent permitted by law, TourneyTek will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, data, goodwill, or business interruption arising from or related to use of the Service.
11. Governing Law
These Terms are governed by applicable U.S. law and, where applicable, the law of the state in which TourneyTek, Inc. is organized, without regard to conflict-of-law rules.
