Poker Hawk – End User License Agreement (EULA)

This End User License Agreement ("EULA") is a legal agreement between you and TourneyTek, Inc. for use of Poker Hawk software applications, including desktop, mobile, and related components ("App").

By downloading, installing, or using the App, you agree to this EULA, our Terms of Use, and our Privacy Policy.

1. License Grant

Subject to your compliance with this EULA, TourneyTek grants you a limited, non-exclusive, non-transferable, revocable license to install and use the App for your internal, lawful use.

2. Restrictions

You may not:

  • Copy, modify, adapt, translate, or create derivative works from the App;
  • Reverse engineer, decompile, disassemble, or attempt to extract source code;
  • Rent, lease, sublicense, sell, or redistribute the App;
  • Use the App in violation of applicable law.

3. Subscriptions, Billing, and Auto-Renewal

Certain features require paid subscriptions. Subscription options, duration, and pricing are shown in-app at time of purchase.

  • Subscriptions renew automatically unless canceled before renewal.
  • For Apple App Store and Google Play purchases, billing, renewals, cancellation, and refunds are handled by the applicable store under its policies.
  • For web purchases, billing is processed by Stripe and managed in your account portal.

4. Ownership

The App and all related intellectual property rights are owned by TourneyTek and its licensors. This EULA grants a limited license, not ownership.

5. Data and Privacy

Your use of the App may involve collection and processing of account and tournament-related information as described in our Privacy Policy.

6. Termination

This EULA remains effective until terminated. It terminates automatically if you fail to comply with its terms. Upon termination, you must stop using the App and remove all copies.

7. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law.

8. Limitation of Liability

To the fullest extent permitted by law, TourneyTek is not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits/data, arising from use of the App.

9. Governing Law

This EULA is governed by applicable U.S. law and, where applicable, the law of the state in which TourneyTek, Inc. is organized.
